NEW HORIZON COACHING - PIVOT YOUR JOB SEARCH PROGRAM

Thank you for your interest in working together. Please read this information carefully.

The purpose of this Agreement is to set forth the details about working together so that we both are clear as to what each of our respective roles are and how our communication will take place so that our time will be positive, productive, and comfortable.

This Agreement is being made between New Horizon Coaching (“Coach”) and you (“Client”).

New Horizon Coaching agrees to provide Program, “Pivot Your Job Search” (herein referred to as “Program”). As a condition of participating in the Program, you agree to be bound by and to abide by all policies and procedures set out in this Agreement, including those incorporated by reference.

PROGRAM DESCRIPTION.

A 4-week coaching program to help you land a new leadership role in a competitive job market without soul-destroying rejections, tedious recruitment processes or an MBA!

The Program includes:

1 x Private 1-on-1 Brand Message (UVP) Coaching Sessions (50-minutes)
Resume, LinkedIn & Cover Letter Critique.
2 x 60-Minutes Mock Interview Training Sessions (Group)
1 x Mindset Session (Group)
1 x Job Search Training (Group)
Private WhatsApp Support & Video Feedback
Private Membership Area With Extensive Video Training
Workbooks, Scripts & Templates
Exclusive FB Group

At any stage and without notice or need for consent – the content of the program can be can subject to change.

As part of the Program, the Company shall provide the following to the Client:

A Password Protected Program Area: The Company shall maintain a Program Area that will include video, templates, templates, worksheets, checklists, slide decks and other training and support information. You shall have access to this Program Area for as long as you are part of the membership.

From time to time, the Company will offer bonuses to individuals who sign up for the Program. You shall be entitled to any bonuses offered to you at the time of your enrolment. Bonuses are not guaranteed to be available for the entire lifespan of the program and they vary depending on specific live and automated promotions throughout the year.

OUR RESPONSIBILITIES.

As your Coach, my role is to:

Be on time and prepared for each Session.
Offer support and accountability throughout the Program.
Help you stretch and focus on the homework and action steps you need to take towards your desired outcome.
Answer any questions you may have as they arise.

As the Client, it is your responsibility to:

Show up
Give 100% of your effort and fully commit to the Program
Be open to new ideas
Come to the Sessions willing to stretch and grow.
Approach each Session with a beginner’s mindset and prepared to get the most out of it.
Complete the homework and action steps between Sessions.
Promptly provide payment for the Program.
Ask any questions you may have as they arise.

Scheduling.

Contacting Me: I try to be attentive to my clients. I will do my best to respond to phone calls or email inquiries within twenty-four (24) - forty-eight (48) hours Mondays through Thursday. On weekends and holidays, I will reply to your e-mail the next business day. Please note that my e-mail between Sessions will be brief answers to your questions by laser-style response. Should you need to discuss something at length, I may request that we wait and discuss your question during our Group or 1:1 Sessions as they are intended for in-depth discussions related to the Program.

Scheduling Your Sessions: You will receive the links to schedule your Sessions through the private membership site. We may also agree to your next Session in Session. I will call you at the start of our Sessions via Zoom or phone (upon agreement). We both have busy schedules, and I take pride in not keeping you longer than planned. We both agree to do our best to start and end each Session on time.

Cancellation or Rescheduling: If you need to cancel or reschedule a Session for any reason, you must do so twenty-four (24) hours in advance via email; otherwise, you will forfeit that Session and will not be able to reschedule it, unless a last minute emergency arises and you contact me by e-mail at [email protected] to let me know of the nature of the emergency. If I specifically offer you the opportunity to reschedule the Session, the rescheduled Session must be made up within two weeks of the original booked in date or it is forfeited.

Investment and Payment.

Payment: Your investment in the program is a one-off of $997 AUD. After (1) month, you can join the alumni membership.

Guarantee: I want you to be happy with the Program. If you do your homework as instructed, show up for your sessions and you don’t see any value in the program, within 1 week (7 days), you’ll have the opportunity to withdraw from the program and I’ll give you 100% of your money back.

However, if you decide to withdraw or cancel after the first week (after 7 days) for any reason whatsoever, you will not be entitled to a refund or pro-rated refund.

Confidentiality. We will keep all information exchanged during the Program in strict confidentiality. I am prohibited from disclosing protected confidential information to anyone else without reason to know such information, except as when required by law or upon written authorization by you.

Intellectual Property Rights.

I retain all ownership rights to the materials provided to you through your participation in the Program. The copyrighted and original materials shall be provided to you for your individual use only and with a single-user license. You are not authorized to share, copy, distribute, or disseminate any materials received from me electronically or otherwise without our prior written consent. All intellectual property, including the copyrighted Program materials, shall remain my sole property and no license to sell or distribute our materials is granted or implied. You agree not to reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial or personal purposes, any portion of the Program, including any of the Program materials.

Personal Responsibility, Disclaimer & Release of Claims.

Personal Responsibility & Assumption of Risk: You acknowledge that you take full responsibility for your health and well-being and all personal and career/business

decisions made before, during and after your Program. I have used care in preparing the information provided to you, but all of my information, programs and services are made available to you as self-help tools for your own personal use related to your life and career, and for informational and educational purposes only. You accept full responsibility for all of your choices, actions and results, and expressly assume the risks of the Program for your use, or non-use, of the information provided by us to you. You also understand that you are expressly assuming all of the risks of the Program, whether or not such risks were created or exacerbated by the Program.

Disclaimer: You acknowledge that I am supporting you in my role exclusively as the Founder of ‘New Horizon Coaching’. In this role, I serve solely as a Career and Leadership coach, providing development and coaching for educational and informational purposes only. I do not provide medical, financial or legal advice. You agree that you are personally responsible for your results, and that while I serve as your guide, your success depends primarily on your own effort, motivation, commitment and follow-through. You accept and understand that results differ by each individual, and as with any career related program, specific results cannot be guaranteed. By participating in the Program you are consenting to this Disclaimer.

Release of Claims: I will not be held legally responsible for the information that you request or receive through this Program. By participating in the Program, you assume all risks and fully and completely hold harmless, indemnify and release me and any other of my employees, shareholders, directors, staff, consultants, agents, or anyone affiliated with me from any and all liability, damages, causes of action, allegations, suits, sums of money, claims and demands whatsoever, in law or equity, that you ever had, now have or will have in the future against me, arising from your participation in or in any way related to the Program, unless arising from the gross negligence on my part.

Other Important Terms.

Termination: Either of us may terminate this Agreement with seventy-two (72) hours written notice to the other. E-mail notification is permissible and sufficient to the e-mail addresses as set forth at the end of this Agreement. All Investment and Refund Policy terms as written above in this Agreement, and all of the terms of this Agreement, will still apply even after termination.

Entire Agreement, Assignment, Survivability and Waiver: This Agreement contains our entire agreement. This Agreement may be modified or amended at any time if the amendment is made in writing. You may not assign your rights or obligations under this Agreement to anyone else. In the event that any part of this Agreement is deemed invalid or unenforceable, it shall not affect the validity or enforceability of any of the remaining portions of the Agreement which shall be severed and remain in full force. The failure to enforce any provision of this Agreement shall not be construed as a waiver or limitation of the right to later enforce and compel strict compliance with every part of this Agreement.

Governing Law: This Agreement shall be construed according to the laws of the State of New South Wales, Australia and both parties shall comply with all ordinances, regulations and rules of the State of New South Wales.

Dispute Resolution: It is hoped that should we ever have any differences, we could be able to work them out through a phone conversation or e-mail correspondence. However, should a dispute ever arise between us, you agree now that the only remedy that is

available to you, or that can be awarded to you, is full refund of your Payment. No award of consequential or of any other type of damages may be granted to you.

Non-Disparagement: In the event of a dispute between us, you agree to not engage in any conduct or communications, public or private, designed to disparage the Program or me.

By participating in the Program, we are both acknowledging that we have read, understand, agree to and accept all of the terms in this Agreement.
